TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the KOBP Fitness website at kobpfitness.com and web application at app.kobpfitness.com (collectively, the "Service"), operated by KOBP Fitness LLC ("KOBP Fitness," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Description of Service

KOBP Fitness is a strength training tracking application that allows users to log workouts, track progress over time, view progress charts, generate shareable session summary cards, and receive AI-generated training analysis ("Coach AI"). The Service is provided as-is and may be updated, modified, or discontinued at any time.

3. Health and Fitness Disclaimer

By using the Service, you acknowledge and agree that:

• KOBP Fitness LLC is not a licensed medical provider, physical therapist, or certified personal trainer
• The Coach AI feature generates automated analysis based on your logged training data and does not constitute professional coaching, medical advice, or a personalized training program
• You should consult a qualified healthcare provider or certified fitness professional before starting or modifying any exercise program, particularly if you have any pre-existing medical conditions, injuries, or health concerns
• You assume full responsibility for your own health, safety, and wellbeing in connection with any physical activity undertaken in connection with use of the Service
• KOBP Fitness LLC is not liable for any injury, illness, loss, or damage arising from or related to your use of the Service or any training activities you undertake
• Strength training involves inherent risk of injury — always use proper form, appropriate weights, and train within your abilities

4. Coach AI Feature

• Coach AI outputs are generated by an AI language model and may contain errors, inaccuracies, or recommendations that are not appropriate for your individual situation
• AI-generated training recommendations do not account for your full medical history, current physical condition, or individual circumstances
• KOBP Fitness makes no warranty that Coach AI outputs are accurate, complete, or suitable for any particular purpose
• You use the Coach AI feature entirely at your own risk
• By using the Coach AI feature or subscribing to Premium, you consent to your training data being transmitted to Anthropic, PBC for processing, as described in our Privacy Policy
• If you have granted Apple Health permission, Coach AI may also include health and recovery data from Apple Health (resting heart rate, HRV, sleep, VO2 Max, and strength workout sessions) in its analysis. This data is transmitted to Anthropic solely for the purpose of generating your analysis and is never stored on KOBP Fitness servers. You can revoke Apple Health access at any time in iPhone Settings → Health → Data Access & Devices → KOBP Strength.

4a. Automated Weekly AI Analysis (Premium)

As part of the Premium subscription, KOBP Fitness performs automated weekly analysis of your training data using Anthropic's Claude API. By subscribing to Premium, you agree to the following:

• Your workout log (lift names, weights, sets, reps, dates, and body weight) is automatically transmitted to Anthropic, PBC each week for the purpose of generating longitudinal coaching insights, plan adherence scores, and lift progression predictions
• This automated analysis runs server-side without a per-session confirmation prompt — your consent is given at the time of Premium subscription
• The resulting analyses and predictions are stored in your KOBP Fitness account and accessible in the app
• Automated analysis only runs for accounts that have logged at least 2 workouts in the prior 14 days
• All AI-generated insights are for informational purposes only and do not constitute professional coaching or medical advice
• Automated analysis stops upon cancellation of your Premium subscription or deletion of your account. All stored analyses are permanently deleted when you delete your account

5. User Accounts and Data

KOBP Fitness requires an account for cloud sync and premium features. Your training data is stored locally on your device and automatically backed up to our cloud servers when you are signed in. You are solely responsible for:

• Maintaining the security of your account credentials
• Any data loss resulting from account deletion, subscription expiry, or device loss
• Ensuring the accuracy of data you enter into the Service

5a. Global Leaderboard

The Service includes an optional global leaderboard feature. Participation is strictly opt-in. By choosing to join the global leaderboard, you agree to the following:

• Your display name, bodyweight, and top set performance data will be stored on KOBP Fitness servers and made visible to other users of the Service
• You can withdraw from the global leaderboard at any time — your data will be deleted from our servers promptly upon opting out
• You are responsible for ensuring your display name does not contain offensive, defamatory, or inappropriate content. We reserve the right to remove any entry that violates these standards
• Leaderboard data auto-expires after 90 days of inactivity
• We do not guarantee the accuracy of leaderboard rankings or the authenticity of data submitted by other users

5b. Cloud Backup

All account holders receive automatic cloud backup of their training data. By creating an account, you agree to the following:

• Your training data will be transmitted to and stored on Cloudflare KV servers under your account ID
• You are responsible for keeping your account credentials secure
• Cloud data is retained for 13 months from your last activity and automatically renewed on each sync
• You can delete your cloud data at any time from the app settings — this action is permanent and cannot be undone
• KOBP Fitness LLC is not liable for data loss resulting from account deletion, subscription expiry, or Cloudflare service interruptions
• We reserve the right to suspend cloud backup access if usage patterns suggest abuse

5c. License and EULA

Your use of the KOBP Fitness iOS app is also governed by Apple's standard End User License Agreement (EULA), which is incorporated into these Terms by reference. You can review Apple's standard EULA at:

KOBP Fitness LLC is the licensor of the KOBP Fitness app. In the event of any conflict between these Terms and Apple's standard EULA, Apple's standard EULA shall govern with respect to the license terms for the app.

6. Paid Subscriptions and Apple In-App Purchases

KOBP Fitness offers both a free tier and paid subscription plans available through Apple In-App Purchase. All purchases are processed by Apple and subject to Apple's payment terms and the EULA incorporated in section 5c. By purchasing a subscription you agree to the following:

• Subscription fees are billed in advance on a monthly or annual basis depending on the plan selected
• All fees are in US dollars unless otherwise stated
• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your iPhone Settings → Apple ID → Subscriptions — access continues until the end of the current billing period
• Refunds are handled by Apple in accordance with their refund policy. You may also contact us at hello@kobpfitness.com within 14 days of purchase for assistance with refund requests
• We reserve the right to change subscription pricing with 30 days notice to existing subscribers

6a. Paid Subscriptions via Web App (Stripe)

If you subscribe to Premium through our web app at app.kobpfitness.com rather than the iOS app, your subscription is processed by Stripe, Inc. ("Stripe") instead of Apple. By purchasing a web subscription you agree to the following:

• Subscription fees are billed in advance on a monthly or annual basis depending on the plan selected, in US dollars
• Your payment card details are collected and processed directly by Stripe — KOBP Fitness never receives or stores your full card number
• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your web subscription at any time by contacting hello@kobpfitness.com — access continues until the end of the current billing period
• Refund requests for web subscriptions may be sent to hello@kobpfitness.com within 14 days of purchase and are granted at our discretion
• We reserve the right to change subscription pricing with 30 days notice to existing web subscribers
• Use of Stripe's payment processing is also subject to Stripe's Terms of Service

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service for any commercial purpose without our written consent
• Circumvent any access controls or subscription restrictions

8. Intellectual Property

The Service, including all content, features, functionality, design, text, graphics, logos, and software, is owned by KOBP Fitness LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

You retain ownership of the training data you enter into the Service. By using the Coach AI feature, you grant us a limited, non-exclusive license to transmit your training data to Anthropic solely for the purpose of generating your requested analysis.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

KOBP FITNESS LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY CONTENT, INCLUDING COACH AI OUTPUTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KOBP FITNESS LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Physical injury or harm arising from training activities
• Loss of data resulting from use of the Service
• Any reliance on Coach AI outputs or other content provided through the Service
• Service interruptions, errors, or unavailability

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO KOBP FITNESS IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50 IF YOU HAVE NOT MADE ANY PAYMENTS.

11. Indemnification

You agree to indemnify, defend, and hold harmless KOBP Fitness LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service at any time with or without notice. We may update these Terms at any time. Significant changes will be communicated by updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which KOBP Fitness LLC is registered, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KOBP Fitness LLC regarding the Service and supersede all prior agreements and understandings.
